FINANCIAL EDUCATION WORKSHOPS
[February 21, 2013]

The Office of the Standing Chapter 13 Trustee, David Ruskin, is pleased to announce a series of FREE workshops for people in the Chapter 13 process.

The workshops are:
  • Credit Reporting, Scoring & Rebuilding
  • Financial Dangers: How to Protect Yourself
  • Money Management Basics
  • Developing Your Budget
  • So, Your Plan is Confirmed... Now What?

    Each class will be offered several times during the year. The classes run from 7:00 P.M. to 8:30 P.M. and are held in the Conference Center at our office.

    Space is limited and the workshops are open only to those who are currently in Chapter 13 with cases assigned to David Ruskin.

    New Form Order
    [February 21, 2013]

    An Order Allowing Debtors to Obtain Credit has been created specifically for motor vehicle loans. The form can be found on the Library section of our website, under the Bankruptcy Forms link.

    Please download a copy of the order and begin using it immediately.

    Notice Regarding New CM/ECF Code for Mortgage Modifications
    [February 11, 2013]

    The Clerk of the Court has created new CM/ECF event codes for filing post-confirmation loan modifications (one for trial modifications, one for permanent modifications). The notice can be read at the Bankruptcy Court's website HERE

    Note that the Court has indicated that they will strike modifications that are not filed with the correct code.

    Announcing Model Plan 3.0!
    [November 12, 2012]

    Pursuant to Administrative Order No. 12-05, effective January 2, 2013, all Chapter 13 cases filed in the Eastern District of Michigan will be required to use the new Model Plan 3.0.

    Version 3.0 of the plan can be found at www.13edm.com as well as on in the Bankruptcy Forms and Documents section of our website, under the Library tab. Word, Word Perfect and PDF versions are available.

    New Status Confernce Time Slots
    [September 10, 2012]

    The attorney time slots for status conferences in cases assigned to Judge Shefferly and Judge McIvor have been modified. Please click on the links below to obtain copies of the new list.

    Emailing the Trustees with Debtor Financial Documents

    The Offices of Krispen S. Carroll, David Wm. Ruskin, Tammy L. Terry and Carl L. Bekofske are pleased to provide coordinated procedures related to sending debtor financial documents via email. The process uses a program called the central email reader. The program has some limitations, which are outlined within the document found below. It is our goal to keep the procedures for our offices as similar as possible.

    The joint document, which includes detailed instructions for the use of the program as well as examples, can be found HERE.

    The aim of this program is to provide the debtor bar with an easy to use method for getting these documents to the Trustee offices and for the Trustees to ensure that these documents are being received and reviewed timely by the proper staff. However the limitations in the program can cause disruptions for everyone if the instructions are not followed. Please make sure your staff have a copy of the joint document to ensure that all documents are sent correctly.

    Order Confirming Plan Format
    [April 23, 2012]

    The Order Submission program that the Court has provided for Trustees will now accept Orders formatted by Word 2007 and 2010 (the "DOCX" format). The Submission of Orders Confirming memo, found HERE, has been updated to reflect this change. To summarize, our office will now accept orders in the following formats:

  • doc (Word 2003 and earlier)
  • docx (Word 2007 and later)
  • wpd (Word Perfect)

    Our office will reject orders submitted in any other format as the Court will not accept the document.

    IRS guide to Form 2848
    [April 7, 2010]

    The IRS has a pamphlet detailing how to complete Form 2848, along with a checklist of common problems.

    IRS Form 2848 - Power of Attorney
    [March 25, 2010]

    On March 12, 2010, the Judges of the United States Bankruptcy Court for the Eastern District of Michigan issued a Notice that in all Chapter 13 cases where the Plan has not yet been confirmed and in which the Plan provides for payment of tax refunds to the Trustee, the debtor shall sign, as requested by the Trustee, IRS forms to authorize the IRS to forward those tax refunds directly to the Trustee.

    A sample completed IRS Form 2848 can be found in the Forms section of the Library page of this website.

    The Chapter 13 Trustees have discussed this requirement and have adopted a processes to implement this new Notice.

    Joint ECF Announcement
    [August 4, 2006]

    The Standing Chapter 13 Trustees for the Eastern District of Michigan have issued a joint memo regarding service of documents per LBR 9013-3 and ECF Procedure 4(e). The memo can be found HERE in PDF format.

    Policy Regarding Fee Applications
    [October 7, 2003]

    The offices of Tammy Terry, Krispen Carroll and David Ruskin have agreed to a standardized policy for dealing with fee applications in dispositive orders.
